THESE TERMS & CONDITIONS ARE PART OF THE MOTORCYCLE RENTAL CONTRACT BETWEN HAPPY RIDER MOTORCYCLES S. L. - HRM - ( LESSOR ) AND THE CUSTOMER ( HIRER ).
PLEASE TAKE YOUR TIME AND READ THIS CAREFULLY.

1 - DRIVER - PASSENGER
Hirer must be at least 25 years of age, must be in possession of a valid driving licence - International Driving Licence for non EU citizens - with motorcycle endorsment for the rented motorcycle and have at least 3 years of riding experience operating large capacity motorcycles. Passengers should be at least 16 years of age.
2 - INSURANCE COVERAGE
A rental motorcycle at HRM is insured for legal liability with third party liability insurance against damage
to persons and properties. With limit of € 50.000.000 ceiling for third party damage.
The motorcycle itself has collision, theft and fire insurance coverage, with an excess or deductible of
€ 1.000 for Honda XL650V and € 1.500 for other models -Honda XL700V, BMW F650GS, Suzuki DL650V -. Said amount will be required to Hirer, on credit card, as "security deposit" on acceptance of the motorcycle. Security deposit is fully refundable against return of undamaged motorcycle.
Any damage to the motorcycle is deducted from security deposit, up to the amount of the deposit.
Hirer understand that despite of fully comprehensive liability insurance, he/she was still responsible and liable for damages for non compling with terms, of this agreement, listed in clause 5 .
3 - ADDITIONAL INSURANCE
HRM strongly recommended to each customer, taking out adequate travel insurance, covering personal acci- dent, illness, theft, lost luggage, liability and legal protection as well as trip cancellations. Such insurance co- verage is not included in the rental price and is responsability of the costumer to obtain.
4 - LESSOR RESPONSABILITIES
All motorcycles at HRM shall be delivered to Hirer in perfect running conditions and fully serviced.
If a malfunction is detected it must be comunicated to HRM as authorization for expenditure must be obtained from Lessor prior to commencement of the repair.
The Lessor does not guarantee to replace a motorcycle in the event of an accident or breakdown.
Lessor is not liable for any damage or loss the Hirer may sustain as result of a vehicle defect or breakdown should cause delay or prevent Hirer from continuing the journey. Lessor is not liable for any kind of expen- ses if not previously authorized. Early return of the motorcycle shall not reduce rental charges.
5 - HIRER RESPONSABILITIES
a - Hirer shall return the motorcycle together with all documents, tools, accessories and equipment in the same condition as when received to the place and on the date specified in the RENTAL CONTRACT and shall use the vehicle in a reasonable manner in accordance with the road traffic regulations.
b - Hirer assume all fines and Court cost for parking, traffic or other offences incurred in relation to the rented motorcycle since commencement of this Agreement until the motorcycle is returned to Lessor.
c - Hirer undertakes to keep the motorcycles properly parked and locked when not in use.
d - Hirer is fully responsible for all damages of the rented vehicle due to neglect.
e - Hirer must return the motorcycle with as much fuel as received.
f - To extend rentals Hirer must inform Lessor at least 24 hours in advance and get authorization thereof.
g - Hirer is liable for damage or loss of rented accessories - luggage, GPS... - , articles transported, stored or left unattended in the rented motorcycle.
h - In case of accident when the motorcycle is damaged or cause damage, Hirer undertake to do not leaves the site she/he was involved before the case was investigated on the spot by the Local Police Authorities and notify Lessor of the ocurred. Hirer shall be further required to make a sketch of the place, adding the names and addresses of the person/s who have been party of the accident, of witnesses and any other pertinent details.
Hirer should avoid making any verbal or written promises. In case of not compliance with these request
Hirer shall be fully responsible of all damages or losses sustained in the case.
THE MOTORCYCLE SHALL NOT BE USED :
i - Knowingly for any unlawful purpouse.
j - By any person other than the Hirer who signed the Rental Agreement or who has been nominated as a Driver by Hirer and approved by Lessor.
k - If phisical-condition is impaired by alcohol, drugs, fatigue or illness.
l - For racing, reliability trials, speed testing or riding tuition.
m - To carry a greater number of passengers and /or more luggage than recommended by the Manufacturer.
n - Off road, on beaches or on unpaved roads.
o - Without wearing and approved helmet at all times when riding the motorcycle.
6 - PLACE OF JURISDICTION
Spanish Law is applicable to this RENTALS AGREEMENT in case of disagreement cannot be amicably settled, the parties agree to submit the dispute to the jurisdiction of the Court of Law of Madrid. Hirer expressly agrees to abide by the decisions of the Courts of Law of Madrid - SPAIN.
